ORDER

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent. 2.On 17.06.2020, the petitioner was found roaming in violation of the lockdown restrictions. He was also not wearing any mask. Therefore, the impugned FIR came to be registered for the offences under Sections 269 and 188 of IPC. To quash the same, this criminal original petition has been filed.

3. It has been already held in many decisions that a police office cannot register a case for the offence under Section 188 of IPC. There is nothing on record to show that the petitioner had contributed to the spread of the disease. Since no adverse consequence ensued, the continuation of the impugned prosecution is not warranted. The impugned FIR is quashed. Crl.O.P.(MD)No.20145 of 2021 Petition is allowed. Consequently, connected miscellaneous petition is closed.
