Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondent to pay the petitioner interest at the rate of 6% per annum, for the period of delay from 28.08.2022 to 30.05.2023, in paying the amounts paid towards the terminal benefits namely EPF Employees Contribution, Gratuity and Encashment of Leave of her deceased husband/retired employee (Late). D. Rajendran, Staff No.A32266, within a time frame as may be fixed by this Honble Court and without affecting the right to claim balance amounts towards those benefits. ORDER

The instant writ petition has been filed by a retired employee of the respondent transport corporation, seeking interest for the belated disbursement of the terminal benefits.

2.According to the learned Counsel appearing for the writ petitioner, the petitioner's husband died while in service on 08.12.2019. The terminal benefits were released only on 02.06.2021. Hence, the petitioner has sent a representation on 15.07.2023, seeking interest for the belated disbursement of the terminal benefits. Since the same has not been considered, the present writ petition has been filed.

3.Considering the above said facts, the respondent herein is directed to pay 6% interest from the due date till the date of disbursement within a period of twelve weeks from the date of receipt of a copy of this order. 2/4

4.With the above said observations, this writ petition stands disposed of. No costs.
