To set aside the order in M.C.No.27 of 2022 dated 17.09.2022 passed by the learned District Family Court, Ramanathapuram. Order : This criminal miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/s.V.RAJIV RUFUS, Advocate for the petitioner, the Court made the following order:- This Criminal Miscellaneous Petition has been filed to condone the delay of 449 days in filing the present revision case against the order passed in M.C.No.27 of 1/3

2022, dated 17.09.2022 on the file of the District Family Court, Ramanathapuram District.

2. Heard the learned counsel for the petitioner.

3. The learned counsel for the respondent filed a counter stating that the petitioner has not stated sufficient reasons to condone the delay. However, he has not expressed any serious objection to allow this petition.

4. I have perused the affidavit filed in support of this petition and being satisfied with the reasons stated in the affidavit and also considering the fact that the dispute is only a matrimonial dispute between the parties, this Court is inclined to condone the delay, but on terms. Hence, this petition will be allowed on payment of cost of Rs.2,000/- (Rupees Two Thousand Only) by the petitioner to the respondent on or before 26.11.2024.
