This writ petition has been filed for issuance of a writ of Mandamus, directing the respondents to recalculate and revise the petitioner's terminal benefits including pension, gratuity, leave encashment and other retirement benefits on the basis of the petitioner's acquittal in both the criminal cases registered against him and consequently disburse the differential amounts together with applicable interest within a time frame fixed by this Court.
2. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing on behalf of the respondents. 2/6
3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
4. When the petitioner was working as a Selection Grade Driver Perambalur Branch under the 2nd respondent, he was retired from service on 31.05.2023. During his tenure of service, two unfortunate road accidents occurred which led to the registration of criminal cases against the petitioner and later, after full-fledged trial, the petitioner was acquitted on 28.09.2011. though the two criminal cases. The grievance of the petitioner is that despite the fact that the petitioner was acquitted in both criminal cases, the 2nd respondent imposed a punishment of postponement of annual increment for two years with cumulative effect vide two proceedings dated 05.11.2013 and 12.04.2013. Hence, the petitioner made a representation to the respondents seeking withdrawal of punishment and restoration of the monetary benefits including revision of pension. However, since no action was taken on the said representation, the 3/6
petitioner has now approached this Court by filing the present Writ Petition.
5. Learned counsel for the petitioner would further submit that the petitioner would be satisfied if a direction is issued to the respondents to consider the representation of the petitioner dated 16.06.2025 and pass appropriate orders thereon, within a time frame to be fixed by this Court.

Considering the above facts and circumstances, without going into the merits of the case, this Writ Petition is disposed of with a direction to the second respondent, to consider the representation of the petitioner dated 16.06.2025 and pass appropriate orders in accordance with law, after affording an opportunity of hearing to all the parties concerned. Such exercise shall be completed as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open 4/6
