IPC in Crime No.16 of 2023 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the defacto complainant is the father-in-law of the petitioner herein. The marriage between the petitioner and the daughter of the defacto complainant was solemnized on 30.08.2020. Thereafter, due to some difference of opinion, they were separated and the daughter of the defacto complainant filed divorce petition and the same was dismissed. Thereafter, the petitioner has created a fake facebook account in the name of the defacto complainant's daughter and harassed her in many ways and hence, again she filed divorce petition and the same is pending. However, the petitioner is continuously harassing the daughter of the defacto complainant. Hence, the defacto complainant lodged the present complaint.
3.The learned counsel for the petitioner would contend that the petitioner in an innocent person and he has been falsely implicated in this case. There was dispute between the husband and wife and now, the petitioner is ready to live with his wife. Therefore, he prayed for anticipatory bail to the petitioner. 2/4
4.The learned Additional Public Prosecutor would submit that the petitioner herein morphed the photos of the defacto complainant's daughter, who is the none other than his wife, and circulated the same in the social media. That apart, the petitioner herein is having four previous cases. Hence, he strongly objected to grant anticipatory bail to the petitioner.
5.Heard both side and perused the materials available on record. 6.Considering the rival submissions on either side and also considering the gravity of the offence and also considering the fact that the petitioner is having four previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
