JUDGMENT

[Judgment of the Court was made by R.SUBRAMANIAN, J.] We see no ground to entertain the writ appeal as the issue is already subject matter of a civil suit.

2. Mr.T.Lajapathi Roy, learned senior counsel appearing for the appellant would however submit that the observations in para 3 of the order of the writ Court may prejudice the rights of the appellant before the Civil Court. We make it clear that the Civil Court will decide the matter on its own merits based on the evidence placed before it without being influenced by any of the observations made in the order of the Writ Court.

3. The writ appeal is disposed of with the above observations. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
