PRAYER :- For Bail in Crime No.216 of 2023 on the file of the respondent Police. ORDER : The Court made the following order :- The petitioner/3rd accused herein, who was arrested on 07.08.2023 for the alleged offence under Sections 294(b), 308 of IPC and 27(2), 29(a) of Arms Act, 1959, in Crime No.216 of 2023 on the file of the respondent Police, seek bail. 1/3

The case of the prosecution is that the defacto complainant lodged a complaint stating that on 07.08.2023 at around 3.00 p.m., when he was riding the two wheeler, which belongs to his friend Naveen bearing Registration No.TN 63 BR 5500 near Kamatchiyamman Temple, the another vehicle bearing Registration No.TN 10 AK 4146 came in a rash and negligent manner and tried to hit his vehicle, but he averted the accident. But however, one Rajesh criminally intimidated him. On his information, one Thirumoorthi, who is cousin brother of the defacto complainant also came to that place and enquired about the activity of the above said persons, at that time, the accused persons picked up quarrel and the accused Vairavan by showing country made revolver, threatened them and also shot in the ground. When the neighbours togethered, they were also criminally intimidated and later fled away from that place. On the basis of the above said, they were arrested and remanded to judicial custody.

3. Now Seeking bail, this petition has been filed.

4. It is stated by the learned counsel for the petitioner that even as per the First Information Report, no specific overt act attributed against this petitioner.

5. Reading of the First Information Report indicates that the country made unlicensed revolver was used by the accused in the above said occurrence.

6. Considering the grevious nature of allegation that is made against the 2/3

petitioner, I find no reason to enlarge the petitioner on bail now. If the bail is granted to the petitioner, he may abscond and tamper the evidences and it will hamper the investigation process. Hence, this petition deserves dismissal and accordingly dismissed.
