Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the impugned order passed by the second respondent in his proceedings in Na.Ka.No.(m7) 1155/2021, dated 20.10.2021 and to set aside the same as illegal and consequently direct the second respondent to conduct an enquiry afresh after affording an opportunity to the petitioner.

Mr.N.Satheeshkumar, learned Additional Government Pleader, takes notice on behalf of respondents 1 to 3. In view of the nature of the order now passed, notice is not directed to the fourth and fifth respondents.

2.I had perused the impugned order and though in the reference, S.No.33/8 at Elanthapatti Village, Thiruverumbur Taluk, Trichirapalli District, is mentioned, in the actual order passed by the second respondent/Revenue Divisional Officer, the said survey number had been omitted and does not form part of the directions given by the second respondent. Even the directions given by the second respondent are only to await orders in W.P.(MD)No.5325 of 2021, W.A.(MD)No.646 of 2021 and O.S.No.732 of 2002 pending before https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.22088 of 2021 the Sub Court at Trichirapalli. Even in those litigations, the second respondent had not mentioned S.No.33/8. 3.Therefore, the writ petitioner has only come to Court with apprehensions, which are certainly imaginary and I hope they do not fructify it. If at all S.No.33/8 is some how included with or without the knowledge of the petitioner, the petitioner can certainly approach the court in accordance with manner known to law. 4.With the above observations, the Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
