PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st and 2nd respondents to conduct fair and speedy investigation and to take action against the respondents No. 3 to 5 according to law under BNS Act 2023, recover petitioners car and his belongings from the respondents 3 to 5 and to hand over the same to the 1/5

petitioner within a reasonable time as per the representation of the petitioner, dated 28.06.2025 within a time frame as fixed by this Court.

O R D E R

The petitioner with a grievance that his vehicle has been taken by his father-in-law, without his consent, has lodged a complaint before the respondent police and filed this writ petition, seeking a direction to the respondent police to take appropriate action on the complaint of this petitioner.

2.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor, who takes notice for the respondents 1 & 2 submits on the complaint of this petitioner, the respondent police have conducted a current paper enquiry and closed the same. However, the closure report produced by the learned Additional Public Prosecutor does not even contain the date, on which, the enquiry was conducted by the investigation officer. 2/5

3.In view of the above, this Court directs the Deputy Superintendent of Police, Pudukkottai to conduct an enquiry on the petitioner's complaint, by registering it in CSR and also inform the petitioner about the fate of his complaint.

4.With the above directions, this Writ petition is closed. No costs.
