RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to Suspend the Sentence of imprisonment imposed in S.C.No.7/2021 on the file of the learned Sessions Judge Karur dated 19.04.2022 and enlarge the Petitioner/Appellant on bail pending disposal of the above Crl.Appeal.

PRAYER in Crl.A(MD)No.501 of 2022 :

Pleased to call for the records of the Court below and set aside the judgment and conviction dated 19.04.2022 made in S.C.No.7 of 2021 on the file of the learned Sessions Judge, Karur and acquit the Appellant/5th Accused.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.DEENADHAYALAN S, Advocate for the petitioner and of MR.R.MEENAKSHI SUNDARAM, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- The petition for suspension of sentence filed by the life convict seeking parity with the co-accused.

2.However, this Court does not find the petitioner similar to the co-accused. When this Court about to dismiss the petition, the learned counsel for the petitioner/accused sought permission of this Court to withdraw this petition. He has also made an endorsement to that effect.

CRL MP(MD) No.12292 of 2022 3.In view of the above, this petition is dismissed as withdrawn. Taking note of the fact that the convict is in jail, the Registry is directed to call for the records and prepare the typedset of papers for final disposal. Once the typed-set of papers is made ready, the matter be listed for final disposal, preferably, during the second week of February, 2023.
