PRAYER: Criminal Original Petition has been filed under Section 482 of Cr.P.C., to direct the 1st respondent to instruct the 2nd respondent as do not to harass the petitioner based on suspicion only. ORDER
This petition has been filed to direct the first respondent not to harass the petitioner based on suspicion only.
2. According to the petitioner, she belongs to Kattu Naikar community. In the said community, some of the people are involved in the offence of theft. Due to which, the police officials frequently visited the residence of the said community people for enquiry. For the same reason, the police officials visited the house of the petitioner during night hours without assistance of the lady police officer and called upon her to the police station for enquiry. Due to her illness, when the same was refused, they threatened her and criminally intimidated her. Hence, she sent a representation to the first respondent on 28.08.2023 for taking action against the second respondent. Since there was no action, the second respondent continues to visit the house of the petitioner and harassing her under the guise of enquiry. Hence, she filed this petition seeking the relief of above said direction.
3. When the matter is taken up for hearing, the learned Government Advocate (Crl.Side) on instructions, submitted that the petitioner has involved in 2/4
the offence of chain snatching in Tirunelveli Junction on 02.07.2023. The Junction Police Officer registered a case and arrested her. In that case, she was released on bail on condition. But, she has not complied with the same. In such circumstances, during the festival of Adithapasu at Sankarnkoil, the Junction Police officials received number of complaints from the public regarding chain snatching. Hence, the Police officials perused the CCTV footage coverage of the festival and found that the petitioner was roaming around the place of festival. Under these circumstances only, they have visited the house of the petitioner in order to verify the movement of the petitioner. Hence, there is no merit in this petition nd he prayed for dismissal of this petition.
4. In view of the submission made by the learned Government Advocate (Crl.Side), this Criminal Original Petition is dismissed. 05.09.2023 NCC : Yes/No Index : Yes/No Internet: Yes/No dss 3/4
