ORDER

Heard both sides.

2. The writ petitioner felt aggrieved by the incorporation of the name of one Abdul Hakkim in the certificate issued by the Zonal Deputy Thasildar, dated 09.03.2016. Based on the petitioner's complaint, the Sub Collector, Kumbakonam vide proceedings dated 27.01.2018 cancelled the same. The grievance of the writ petitioner is that no action was taken against the officials who had caused such illegal interpolation. In this regard, the petitioner has given a complaint dated 13.05.2018. The Sub Collector, Kumbakonam had found substance in the petitioner's complaint. That is why, he passed the cancellation order. But one should not stop with mere cancellation. One should also proceed against the official who wrongly issued the certificate. If the issuance of the wrong certificate was bonafide, then it can be overlooked.

If the issuance was vitiated by malafide considerations, then action has to be taken. It is for the Sub Collector, Kumbakonam to take a call in the matter. Calling upon the second respondent to exercise his discretion in the matter on the petitioner's representation, this Writ Petition is disposed of. No costs. 03.11.
