PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondents to disburse all monitory and service benefits by considering the petitioner's representation dated 31.07.2024 and pass such further order within a time frame that may be fixed by this Court.

ORDER

The instant writ petition has been filed by a retired Village Administrative Officer, seeking a mandamus directing the respondents to disburse all monetary and service benefits by considering his representation, dated 31.07.2024. 2/6

2.The petitioner had retired from service on 31.05.2016. Despite several requests, the terminal benefits have not been released, citing pendency of departmental proceedings.

3.The departmental proceedings culminated in a final order dated 06.02.2023, wherein the petitioner was imposed with a punishment of cut in pension of Rs.500/- per month for a period of two years. Thereafter, the provisional pension that was given to the petitioner was also stopped expecting the regular pension to be paid.

4.After the imposition of punishment, neither the provisional pension was paid nor the regular pension was paid. Hence, the petitioner has sent a representation on 31.07.2024 to several respondents, seeking disbursement of service and other terminal benefits.

5.Considering the above said facts, the fourth respondent herein is directed to consider the representation of the writ petitioner and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

6.With the above said observations, this writ petition stands disposed of. No costs.
