Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent to issue legal heirship Certificate for the Petitioner's deceased husband namely Late.Maruthamuthu, who died on 20.01.2025, by mentioning the petitioner's name and petitioner's father-in-law name Seeranga Gounder as legal heirs, based on the petitioner's representation dated 22.04.2025, within time frame stipulated by this Court.

ORDER
This writ petition has been filed for a Mandamus to direct the second respondent to issue legal heirship Certificate for the Petitioner's deceased husband namely Late.Maruthamuthu, who died on 20.01.2025, by mentioning the petitioner's name and petitioner's father-in-law name Seeranga Gounder as legal heirs, based on the petitioner's representation dated 22.04.2025.
2. It is the case of the petitioner that her husband died on 20.01.2025 and that the petitioner along with her in-laws performed all the responsibility associated with the funeral rites of her husband.
3. It is submitted that the petitioner that the petitioner's husband was none other than the maternal uncle of the petitioner and their marriage was solemnized on 27.05.1998. After the marriage, the petitioner lived with her husband in Gujarat, where he was employed with the Indian Oil Corporation. In the Service Register, the petitioner's name has been recorded as the name of the wife of the petitioner's husband.

It is submitted that the petitioner apprehends that the third respondent is attempting to declare herself as the legal wife of the petitioner's deceased husband and therefore, the petitioner submitted a representation to the Revenue Divisional Officer, Srirengam on 24.03.2025, which has been forwarded to the second respondent on 09.04.2025 for issuance of legal heir certificate. However, it has not evoked any response till date.

Considering the nature of the relief sought in this writ petition, the writ petition stands disposed of after dispensing with notice on the third respondent, by directing the second respondent to hold an enquiry and thereafter issue legal heir certificate to the petitioner after due notice to the third respondent. This exercise shall be completed within a period of 6 weeks from the date of receipt of a copy of this order. No costs. 18.08.2025 NCC : Yes / No Index : Yes / No Internet : Yes / No sn 3/5
