This Writ Petition is filed seeking to issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned order passed by the third respondent in his proceedings dated 16.11.2016 and for a consequential direction to the respondents to sanction 3rd incentive increment to the petitioner for having acquired M.Phil degree within the period that may be stipulated by this Court.
2. On behalf of the respondents 1 to 4, a counter affidavit has been filed.
3. During the course of hearing, the learned Government Advocate submits that the issue is already settled by the Full Bench by order dated 29.04.2022 in W.A.No.3674 of 2019 and batch. As such, no further adjudication is required in the present Writ Petition.
4. The learned counsel for the petitioner also endorsed the statement of the learned Government Advocate that the issue is already decided by the Full Bench of this Court.
5. In view of the submissions made by the respective counsels, in my view, further adjudication is not required in this case. Accordingly, this Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. 09.08.2023 Index : Yes / No NCC : Yes / No CM
