For Respondent : Mr.S.S.Madhavan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.195 of 2021 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioners/Accused No.2 & 4, who apprehend arrest at the hands of the respondent police for the offence punishable under sections 294(b), 324 of IPC r/w Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, in Crime No.195 of 2021 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that due to the pathway dispute between the accused and the defacto complainant, the petitioners along with the other accused, abused the defacto complainant with filthy language and also attacked her and caused injuries to her. Hence, this complaint.

3.The learned counsel for the petitioners would submit that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. He would furhter submit that the A1 and A3 have already been arrested and released on bail by the learned Judicial Magistrate No.II, Sattur, on 07.12.2021. 4.The learned Government Advocate (Crl.Side) would submit that the injured was treated as outpatient.
5.Considering the facts and circumstances of the case and also considering the fact that the injured has taken treatment only as outpatient, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.
6.Accordingly, the petitioners are ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Sattur, and on further condition that the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C scrupulously.
