ORDER

Heard the learned counsel on either side.

2.The assignment order dated 25.09.1997 was issued in favour of the writ petitioner. The condition was that the petitioner must put up a residential construction within one year. Since the said condition was not fulfilled, the assignment order came to be cancelled on 11.05.2015. In fact along with the writ petitioner, similar cancellation orders were passed in a number of cases. The entire issue was revisited. The petitioner managed to obtain a fresh order of assignment. Even thereafter, since the authorities came to know that she was attempting to alienate the assigned land, there was an order of second cancellation in her case. The second cancellation was made on 20.04.2016. Thereafter, the impugned list of beneficiaries was finalized. The stand of the 2/4

respondents is that without questioning the order of cancellation made on 20.04.2016, there cannot be challenge to the impugned list of beneficiaries. 3.I find considerable force in the said objection raised by the learned counsel for the respondents. From the typed set of papers, I am able to note that assignment made in favour of the writ petitioner was cancelled on 20.04.2016. When there is no challenge to the said order, there cannot be a challenge to the consequential action taken by the authorities. The writ petition is dismissed as not maintainable. No costs. Consequently, connected miscellaneous petition is closed.
