This writ petition has been filed seeking issuance of a writ of mandamus, directing the second respondent to rectify the error in the entry pertaining to Survey No.77/14, Thiruvithancode Village (now Mulagumoodu Village) Kalkulam Taluk, Kanyakumari District and issue Patta to the petitioner based on his representation dated 16.10.2018.
2. It is brought to the notice of this Court that the petitioner has passed away. Accordingly, this writ petition stands dismissed as abated. However, liberty is granted to the legal heirs of the deceased petitioner to approach the competent authority seeking disposal of the representation dated 16.10.2018. In such case, the second respondent is directed to consider the representation dated 16.10.2018 on merits and in accordance with law and pass appropriate orders within a period of twelve weeks 2/5
from the date of receipt of a copy of this order.
3. The representation shall be considered and disposed of after conducting an inquiry. The second respondent is further directed to afford a reasonable opportunity to the petitioner and to all other persons who may be affected by such decision during the course of the inquiry. In the event of any rival claims, the same can be agitated before the competent civil court. There shall be no order as to costs.
