ORDER
Challenge has been made to the order of the respondent dated 14.09.2015, where the request of the petitioner seeking pension has been rejected and the petitioner was directed to appear before the Medical Board on 08.10.2015 for determination of his age.
2.When the matter is taken up for hearing, the learned counsel appearing for the petitioner has restricted his relief that this Court may fix a time limit, enabling the petitioner to appear before the Medical Board to determine his age, as stated in the impugned order dated 14.09.2015. 3.The learned Government Advocate appearing for the respondent would submit that if the petitioner appears before the Medical Board, appropriate orders would be passed by the authorities concerned. 4.Considering the submissions made on either side and since the petitioner has voluntarily restricted his relief, this Court directs the petitioner to appear before the Medical Board as referred to in the impugned order, within a period of eights weeks from the date of receipt of a copy of this order or on the date on which the Medical Board decides. Thereafter, the Medical Board is 2/4
directed to determine the age of the petitioner and based on which, the respondent is directed to pay pension in terms of the scheme from the date when the petitioner attained the age of 60 years till the date of payment and thereafter, continuously pay pension to the petitioner. 5.With the above direction, this Writ Petition is disposed of. No costs.
