PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondents 1 to 3 to sanction the monetary benefits which all eligible to the petitioner husband with interest on the basis of the representation given by the petitioner dated 27.08.2024 within a time frame fixed by this Court.

ORDER

The instant writ petition has been filed by the wife of an Assistant Manager of the third respondent Co-operative Bank, seeking a mandamus for sanctioning the monetary benefits and for releasing the same, based upon her representation dated 27.08.2024.

2.While an employee was alive, he was facing an enquiry under Section 81 of the Tamil Nadu Co-operative Societies Act, which has culminated while he was in service. The petitioner's husband was facing criminal proceedings in Crime No.1 of 2014. Charge sheet has also been laid in the said case by the C.C.I.W., Trichy. However, pending criminal proceedings, the petitioner's husband has passed away on 17.05.2021 and therefore, the charges as against the petitioner have got abated.

3.In view of the above said facts, the petitioner has sought for a mandamus for releasing the terminal benefits, in view of the fact that the criminal proceedings have already got abated and as on today, there are no 2/4

disciplinary proceedings pending as against the writ petitioner's husband. The respondents herein are directed to release the eligible terminal benefits to the writ petitioner within a period of twelve weeks from the date of receipt of a copy of this order.

4.With the above said observations, this writ petition stands disposed of. No costs.
