Criminal Original Petition filed under Section 528 of BNSS, to direct the Learned Judge, Special Court for Exclusive Trial of Cases under SC/ST (POA) Act, Sivagangai pleased to accept the surrender of the petitioner and consider the petitioner's bail application on the date of surrender itself in Crime No. 342/2025, on the file of the second repondent police.
ORDER
This petition has been filed for extension of time to comply with the orders passed by this Court in Crl.OP.(MD)No.11757 of 2025 dated 18.07.2025. 2.The learned counsel appearing for the petitioner submits that the petitioner received the copy of the order dated 18.07.2025 only on 06.08.2025 and therafter, on 07.08.2025, he served the notice to the learned Public Prosecutor of Exclusive Trial of Cases under SC/ST Act, Sivagangai along with the order of this Court dated 18.07.2025. However, the learned Public Prosecutor informed the petitioner's counsel that time is not enough to serve the paper to the defacto complainant. Therefore, the petitioner filed the present petition. 3.Being satisfied in the reasons stated in the affidavit filed in support of this petition, this petition is ordered with a condition that the petitioner shall pay a sum of Rs.1,000/- (Rupees One Thousand only) to ''The Commissioner, Madurai Corporation, Aringar Anna Maligai, Tallakulam, Madurai - 625 002, Canara Bank, 2/4
Account No.110197467504, IFSC Code: CNRB0003041, MICR Code: 625015017'', within a period of ten days from the date of receipt of a copy of this order, in default, this petition will automatically stands dismissed. The said amount shall be utilized by the Commissioner of Madurai Corporation, for the purpose of making necessary improvements in the Study Centre, Madurai Corporation. The petitioner is further directed to surrender before the Special Court for Exclusive Trial of Cases under SC/ST (PoA) Act, Sivagangai, within a period of 10 days from the date of receipt of a copy of this order.
