by the third respondent and quash the same and consequentially directing the respondents 1 to 3 to mutate the revenue records in respect of the subject property in Survey No.456/1 measuring 5 Acres 30 Cents in Vani Village, Sakkarakottai Group, Ramanathapuram Taluk and District in the name of the petitioner Jamath as per the decree dated 29/07/1997 in O.S. No.441 of 1994 on the file of the District Munsif Court, Ramanathapuram, confirmed by the decree dated 21/01/2022 in S.A.No. 1085 of 2003 before this Court, within a time frame that may be stipulated by this Court.

ORDER

The writ petition is filed challenging the order passed by the third respondent, rejecting the application submitted by the petitioner, seeking mutation of revenue records in respect of the property situated in Survey No.456/1, Vani Village, Sakkarakottai Group, Ramanathapuram Taluk, Ramanathapuram District. 2.A perusal of the impugned order would suggest that the petitioner effectively participated in the enquiry and the impugned order

was also marked to the petitioner. Therefore, there is no violation of the principles of natural justice principles to enable the petitioner to invoke the jurisdiction of this Court under Article 226 of the Constitution of India against the impugned order. Moreover, an appeal lies before the jurisdictional Revenue Divisional Officer under Section 12 of the Patta Passbook Act. Therefore, this Court is not inclined to entertain this Writ Petition. Accordingly, this Writ Petition is dismissed with liberty to the petitioner to move the Appellate Authority under Section 12 of the Patta Passbook Act. No costs. Consequently, connected miscellaneous petition is closed.
