ORDER

The petitioner herein seeks a direction to the respondents 1 and 2 to delete the entry in the Town Survey Land Register pertains to the property situated in T.S.No.67 (Old survey No.717/2), New Ward F,

Block-5, Sevaloor Village, Manapparai Taluk, Trichy District and to issue patta in the name of the petitioner, in the light of the proceeding of the fourth respondent dated 12.07.2011, in Na.Ka.No.S/4605/2011, by considering the his representation dated 02.08.2025. 2.Heard the arguments of Mr.D.S.Haroon Rasheed, learned counsel appearing for the petitioner, Mr.D.S.Nedunchezian, learned Government Advocate appearing for the respondents 1 to 4 and Mr.M.Siddharthan, learned Standing Counsel for the fifth respondent. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

3.According to the petitioner, the subject property belongs to him under four registered sale deeds dated 25.09.2008, 02.04.2009, 26.07.2011 and 08.07.2011. In the Town Survey Land Register maintained by the fifth respondent, there is an entry as if 109 sq.mt of land in T.S.No.67 is a Sarkar Poramboke Pathway. Therefore, the petitioner submitted a representation before the respondents on 02.08.2025, seeking deletion of wrong entry based on the

recommendation made by the fourth respondent dated 12.07.2011. The said representation has not been considered. Hence, the petitioner has come before this Court.

4.The learned Government Advocate appearing for the respondents 1 to 4 would submit that the deletion of wrong entry in the Town Survey Land Register shall be done only by the fifth respondent. 5.The learned Standing Counsel appearing for the fifth respondent would submit that the representation of the petitioner will be considered in accordance with law.

6.In view of the same, without expressing any opinion on the merits of the matter, the fifth respondent is directed to consider the representation of the petitioner dated 02.08.2025, in the light of the proceedings of the fourth respondent dated 12.07.2011, in Na.Ka.No.S/4605/2011 and pass final orders on its own merits, within a period of twelve weeks from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioner and other

interested parties. In case, the fifth respondent passes an order in favour of the petitioner deleting the entry in the Town Survey Land Register, the fourth respondent shall consider the request of the petitioner for issuance of patta thereafter. Accordingly, this Writ Petition is disposed of. No costs.
