PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the 1st respondent to take appropriate steps to get ratification order from the government in respect of petitioner's pay anomaly as per the order of the 5th respondent in Ma.A.No.405/2019 Na.Ka.F2/12936/2019 dated 09.05.2019 and disburse the arrear salary and revise the pension and monetary benefits to the petitioner on the basis of Rs.51,000/- instead of Rs.48,100/- from 01.01.2011.

This writ petition has been filed for issuance of a writ of Mandamus, directing the 1st respondent to take appropriate steps to get ratification order from the government in respect of petitioner's pay anomaly as per the order of the 5th respondent in Ma.A.No.405/2019 Na.Ka.F2/12936/2019 dated 09.05.2019 and disburse the arrear salary and revise the pension and monetary benefits to the petitioner on the basis of 2/6

Rs.51,000/- instead of Rs.48,100/- from 01.01.2011.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing on behalf of the respondents.

3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

The case of the petitioner is that the petitioner was appointed as Grade II police in Pudukkottai District on 01.08.1984 and subsequently promoted as Special Sub-Inspector of Police and when two months remained for his retirement, he retired from the said post under Voluntary Retirement Scheme on 29.02.2016 by the order of the fourth respondent. The grievance of the petitioner is that though the petitioner's basic pay was fixed at Rs.51,000/- by the 5th respondent as per the recommendation of the VII Pay Commission and the same was forwarded to the first respondent for ratification, the first respondent has not passed any order. Hence, the petitioner sent a representation dated 17.07.2025 to 3/6

the respondents. However, since no action was taken on the said representation, the petitioner has now approached this Court by filing the present Writ Petition.

5. Learned counsel for the petitioner would further submit that the petitioner would be satisfied if a direction is issued to the respondents to consider the representation of the petitioner dated 17.07.2025 and pass appropriate orders thereon, within a time frame to be fixed by this Court.

Considering the above facts and circumstances, without going into the merits of the case, this Writ Petition is disposed of with a direction to the first respondent, to consider the representation of the petitioner dated 17.07.2025 and pass appropriate orders in accordance with law. Such exercise shall be completed as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open 4/6
