ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 173 Cr.P.C @ 147, 148 and 302 IPC, in Crime No.1139 of 2020 on the file of the respondent police and hence, seeks anticipatory bail. 2.The petitioner is facing the charges for the offence under sections 147, 148 and 302 IPC.

3.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor.

4.Reading of the FIR shows that two unknown persons were roaming in the village in a suspicious manner and when the villages enquired them, they tried to escape from the village and the villagers traced the people and in the above said chasing, one of the accused persons alleged to have assaulted one of the villagers with wooden log. In the attempt, one of the persons sustained grievous injuries and taken to the hospital, where he reported to be dead. Originally, the case has been registered under Section 174 of Cr.PC. Later it has been altered to 302 IPC and totally, 12 persons https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD) No.19660 of 2021 were arrayed as accused, who are belonged to the same village and one of the accused moved separate petition in Crl.OP(MD)No.16105 of 2012 and during the course of the hearing, the prosecution has submitted that the deceased name is Deepu and he sustained injuries, when the villagers thrown stones and sticks. So finding that the prosecution has not so far gathered any information, who caused the death of the above said Deepu and whether injuries sustained by him was self-inflected by him or that was caused by the villagers. On the basis of the above said 7 persons were granted anticipatory bail by this court. Since the petitioner is also on the very same footing, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

5.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.III, Trichy and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the respondent police daily at 10.00 am, until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
