2. In view of the endorsement made by the learned counsel for the petitioner, this Writ Petition is dismissed as withdrawn. The writ petitioner is given liberty to institute a civil suit on the same cause of action. The time taken to conduct the present writ proceedings shall be excluded while computing limitation.
