PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, calling for the records relating to the impugned proceedings in Na.Ka.No. A4/9615/2022 dated 24.01.2023 on the file of the 1st respondent and quash the same as illegal and consequently forbearing the first respondent from interfering the jurisdiction of the competent civil court.

O R D E R

The petitioner has filed this writ petition as against the notice issued by the Revenue Divisional Officer,Pudukottai, on the appeal preferred by the second respondent under the Tamil Nadu Patta Pass Book Act,1983.

2.The learned counsel appearing for the petitioner submits that this petitioner has already appeared before the Revenue Divisional Officer and has also placed all his documents. However, the respondents without considering the same, once again issued notice. Therefore, the petitioner apprehending that his points and documents have not been considered by the respondents have filed this writ petition.

3.It is only a show cause notice issued in an appeal preferred by the second respondent and this petitioner is having every right to raise all his points before the concerned Revenue Divisional Officer during the enquiry. It appears that the proceedings 2/4

which was initiated in the year 2022 is still pending. Therefore, The Revenue Divisional Officer, Pudukottai, is directed to conclude the proceedings as expeditiously as possible after considering the submissions of this petitioner as well as the second respondent on its merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. The petitioner is at liberty to raise all his grounds before the Revenue Divisional Officer. No costs.
