Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to direct the first and second respondents to remove the encroachment in Survey No.1638-A/84 at Kenguvarpatti Post, Periyakulam Taluk, Theni District based on the representation given by the petitioner dated 30.09.2019.

[Order of the Court was made by T.S.SIVAGNANAM, J.] Heard Mr.A.Uthayakumar, learned counsel appearing for the petitioner and Mr.A.K.Baskara Pandian, learned Special Government Pleader, appearing for the official respondents. By consent on either side, this writ petition is taken up for final disposal.

2. This writ petition has been filed seeking direction upon https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)No.22679 of 2019 the respondents 1 and 2 to remove the encroachment in Survey No.1638-A/84 at Kenguvarpatti Post, Periyakulam Taluk, Theni District by considering the representation of the petitioner, dated 30.09.2019.

3. The learned Special Government Pleader appearing for the respondents 1 and 2 submits that the second respondent will conduct an inspection and survey the area and if any encroachment is found, then notice will be issued to the third and fourth respondents, action will be initiated in accordance with law.

4. The above submission is placed on record and the second respondent is directed to abide by the same and initiate appropriate action after issuing notice to the third and fourth respondents within a period of two weeks from the date of receipt of a copy of this order.

5. With the above direction, this writ petition is disposed of. No costs.
