Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the 3rd respondent to direct the 5th respondent to collect the complaints from the depositors of the Ayushu Nooru Private Limited at Trichy by taking suitable legal action for redeeming the deposited amounts based on the petitioner's representation dated 11.10.2021 within the stipulated time limit as fixed by this Court. ORDER
Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents 1 to 5. Considering the nature of relief to be granted, issuance of notice to the respondents 6 and 7 is dispensed with.
2.The petitioner is said to be a depositor in the petition mentioned company. According to the petitioner, the petition mentioned company has committed default. The petitioner wants his complaint to be enquired into.
3.When the matter was taken up for hearing, the learned Additional Public Prosecutor submitted that already Crime No.1 of 2021 was registered on the file of the Inspector of Police, E.O.WII, Trichy and that the petitioner also will be cited as one of the witnesses. The petitioner apprehends that the fifth respondent may tweak the petitioner's statement to be recorded. I make it clear that the fifth respondent will record the petitioner's statement as it is stated. It is open to the petitioner herein to send a copy of the statement by registered post and thereafter appear in person before the fifth respondent and give a statement in person on the same lines. Be that as it may, the fifth respondent is directed to file the final report on merits and in accordance with law within a period of six months from the date of receipt of a copy of this order.
