ORDER : The Court made the following order :- The petitioner / Accused who apprehends arrest in the hands of the respondent police for the offences punishable under Sections 194 altered to Section 103(1), 109(1), 118(1), 296(b), 351(3) of BNS 2023, in Crime No.371 of 2025 on the file of the respondent police, seeks anticipatory bail,

2. The case of the prosecution is that the petitioner along with other accused persons have attacked the son of the defacto complainant with sickle, due to which, he died. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that based on the confession of co-accused, the petitioner was falsely implicated in this case. Hence, he seeks anticipatory bail.

4. The learned Government Advocate (Criminal Side) would submit that the petitioner along with other accused persons had murdered 2/4

the son of the defacto complainant. He further submitted that initially the case was registered under Section 194 subsequently, the Sections were altered to 103(1), 109(1), 118(1), 296(b), 351(3) of BNS 2023. Hence, he objected to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that the petitioner has involved in very serious offence and the investigation is at initial stage. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

6.Accordingly, this Criminal Original Petition is dismissed. (S S Y J) 23.10.2025 msrm To 1.The District Munsif cum Judicial Magistrate, Radhapuram.
