counsel for the appellant would submit that both the appellant and the respondent are living together under one roof in the paternal home and hence, he seeks time to file a written memo in this regard and at his request, the matter is adjourned today. When the matter is taken up for hearing today, though the learned counsel for the appellant is present, he neither filed a written memo as stated supra or ready to argue the appeal so as to decide the matter on merits. Hence this Court has no other option except to dismiss the Civil Miscellaneous Appeal, for non -prosecution.
