ORDER

The petitioner herein seeks a direction to the respondents 1 and 2 to survey the property situated in Survey No.440/2 situated at Thettupatti Village, Dindigul West Taluk, Dindigul District by considering his application dated 03.07.2023.

2. Heard the learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader, who takes notice for the respondents 1 and 2.

3. By consent of both the parties, the writ petition is taken up for final disposal at the stage of admission itself. 2/6

4. According to the petitioner, the subject property belonged to his mother and after the death of his mother, the petitioner has got the property by succession. The patta for the subject property also stands in the name of the petitioner in Patta.No.4566. He submitted an application on 03.07.2023, seeking survey of the subject property. However, the same has not been considered and hence, the petitioner has come before this Court.

5. The learned Additional Government Pleader who takes notice for the respondents 1 and 2 would submit that the petitioner failed to produce the acknowledgment for having submitted the online application and hence, his request has not been considered.

6. In view of the same, without expressing any opinion on the merits of the matter, the petitioner is directed to produce the acknowledgment for having submitted the online application before the 1st respondent within a period of two (2) weeks from the date of receipt of a copy of this order. On production of acknowledgment, the respondents 1 and 2 shall consider 3/6

the application of the petitioner dated 03.07.2023 and pass final orders on its own merits and in accordance with law within a further period of eight

(8) weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, neighboring land owners and other interested parties.

7. The writ petition is disposed of with the above observations. No costs.
