Respondent/Complainant For Petitioner : M/s.Arunraj K, Advocate For Respondent : M.Veeranthiran, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.133 of 2022 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 294 (b), 323, 324 and 506(ii) IPC, in Crime No.133 of 2022, seeks anticipatory bail.
2.The earlier anticipatory bail petition filed by the petitioner was dismissed by this Court on 20.09.2022, considering the gravity of offence and the fact that the petitioner is having bad antecedent.
3.Now, the petitioner has filed this second anticipatory bail petition, on the ground that the injured was discharged from the hospital and the co-accused was already released on bail. Hence, prays to enlarge him on anticipatory bail.
4.On the side of prosecution, it is stated that in this case, there are two accused involved. The petitioner is arrayed as A1 and https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.18508 of 2022 he is having one previous case, that too under Section 302 IPC. Though the injured was discharged from the hospital, there is no change in circumstances. Hence, prayed to dismiss the petition. 5.Considering the facts and circumstances of the case, though this is the second petition filed by the petitioner, except the fact that the injured was discharged from the hospital, there is no change in circumstances, since the petitioner is having one previous case under 302 IPC and considering the gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition stands dismissed.
