Prayer :- Habeas Corpus Petition is filed under Article 226 of the Constitution of India, praying this Hon'ble Court to directing the respondents No.1 to 3 to produce my son or his body of the detenu namely Minor Shanmugapriyan aged about 17 years ORDER:- Habeas Corpus Petition is coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. K.Baalasundharam, Advocate for the Petitioner and of Mr. K.Dinesh Babu, Additional Public Prosecutor on behalf of the Respondents, this Court made the following order:

( Order of the Court was made by T.RAJA.J) Today, a status report has been filed by the Inspector of Police, Town Police Station, Pudukkottai/3rd respondent herein. Mr.P.Gopalachandran, Deputy Superintendent of Police, Pudukkottai Sub Division has also appeared and assisted brief Mr.K.K.Ramakrishnan, learned Additional Public Prosecutor. 2.Learned Additional Public Prosecutor inviting our attention to the status report, dated 21.01.2020, filed today, explained that 1/3

a special team comprising Head Constable No.1486 and Police Constable No.1323 was formed and it was also sent to Coimbatore and adjoining areas in search of the missing boy. The said team also made several enquiries at Sulur and also informed Sulur Police Station and Ramanathapuram Police Station by handing over the details about the missing boy with bills. The said team also went further to the Coimbatore Railway Station and searched in the crowded places and also pasted bills at all strategic locations and again, they visited Singanllur area and thereafter, they informed the Officials in the Police Station.

Again, they affixed bills at the Police Station notice board and proceeded to Palladam and they have taken various steps informing the Palladam Police Station and also issued pamphlets and kept secret watch at sensitive locations, they are still in search of the missing boy and now, they have returned without any clue to find out the whereabouts of the missing boy. Again, on re-enquiry of the petitioner, on 07.09.2019, it is learnt that the missing boy also studied 10th standard at Vairams Matriculation School, Pudukkotai and he was admitted at Sowdambiga Matriculation School at Thuraiyur for 11th standard and was staying in the hostel and also he was having homesick, as there was an incident took place on 01.09.2019, while the boy was driving a Maruthi Swift Dzire car bearing Regn. No.

TN 55 BD 2669 and caused minor damage to another car bearing Regn.No.TN 55 AR 4288 belonging to one Muthu Kumar. Afraid of the reprimand from his father, leaving a letter, the boy has left the home. In the status report, it is also stated that if some more time is granted, they are able to make a break through.

3.Learned counsel appearing for the petitioner also stated that only on the information given by the petitioner's family that the boy may be found in Coimbatore, the police team has undertaken visit to that place. Hence there is no difficulty for them to wait for some more reasonable time.

4.Taking into consideration of the status report filed by the 3rd respondent indicating wide range of search made by the 2nd and 3rd respondents, we are inclined to grant two weeks time to the 3rd respondent.

5.Post the matter on 04.02.2020. The presence of the Deputy Superintendent of Police, Pudukkottai Sub Division is dispensed with for the future hearings.
