ORDER
The petitioner has filed this Writ Petition seeking for issuance of a Writ of Mandamus, to direct the first respondent to issue passport to the petitioner on the application in File No.MD1074460656922, dated 02.08.2022 within a stipulated time prescribed by this Court.
2.The grievance of the petitioner is that the petitioner submitted an online application to change his signature in the passport bearing No.R4721244 issued on 27.09.2017 before the first respondent. Subsequently, the first respondent sent a show cause dated 29.08.2022 calling for an explanation with regard to the criminal case pending against him. He also submitted his explanation to the first respondent and also appeared in person for enquiry. But, the same is not considered yet. Hence, the petitioner has filed the present writ petition with the aforesaid prayer. 3.Today, when the matter is taken up for hearing, the learned Government Pleader appearing for the second and third respondents has produced a copy of the final report, dated 10.10.2022 filed before the learned Judicial Magistrate, Rameshwaran for the offence under Sections 143, 290, 2/4
270 of IPC and Section 3 of the Epidemic Diseases Act, 1897 as further action dropped as against the petitioner herein.
4.In view of the above submission, it is made clear that no criminal case is pending against the petitioner. Hence, the authorities concerned is hereby directed to re-issue the passport to the petitioner as expeditiously as possible. 5.This Writ Petition is disposed of with the aforesaid direction. No costs.
