The Writ Petition is filed seeking a direction to the respondents 2 and 3 to conduct survey of the property comprised in S.Nos.980/1 and 983/2B1, Ayyalur Village, Vedasandur Taluk, 2.Mrs.S.Jeya Priya, learned Government Advocate takes notice for the respondents 1 to 3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the petitioner, he claims right over the subject property by partition deed, dated 10.11.2008. Patta for the subject property stands in the name of Petitioner's father Periyasamy Pillai in Patta Nos.1261 and 1004. The Petitioner submitted a representation on 9.6.2024 before the official respondents seeking survey of the property. The same has not been considered so far. Hence the Petitioner is before this Court 2/5
with the present Writ Petition for the relief stated supra. 4.Mrs.Jeya Priya, learned Government Advocate who takes notice for the respondents 1 to 3, would submit that the Petitioner has not filed any online application and hence his request for survey could not be considered.
5.In view of the same, without expressing any opinion on the merits of the matter, the Petitioner is directed to produce the acknowledgment for having submitted an online application before the second respondent within a period of two weeks from the date of receipt of a copy of this Order. On production of acknowledgment, the respondents 2 and 3 are directed to consider online application of the Petitioner and pass final orders on its own merits after issuing notice to the Petitioner,Co-pattadhar Muthurama Reddy, neighbouring land owners and other interested parties, if any, within a further period of 12 weeks therefrom.
6.With the above directions, the Writ Petition stands disposed of. No costs.
