ORDER

This petition has been filed seeking order to set aside the order passed in Crl.RC.No.9/2014 dated 20.06.2018 on the file of the Principal District and Sessions Judge, Virudhunagar District at Srivilliputhur, confirming the order passed in M.C.No. 14/2011, dated 04.03.2014, on the file of the Judicial Magistrate, Rajapalayam.

2.When the matter is taken up for hearing, the learned counsel for the petitioner seeks permission of this Court to withdraw the present petition. But the learned counsel for the respondents submitted that the conditional order passed by this Court has not been complied by the petitioner.

3.The learned counsel for the petitioner submitted that after filing of this petition a petition has been filed before the concerned Magistrate Court stating that Rs.88,000/- must be paid being the arrears amount. There is some dispute with regard to the total arrear amount. He is ready to pay the balance amount before the concerned trial Court.
