Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the second respondent vide his proceedings in Ka.No.Se.Po/E.Ka/Mana/Tho.Nu.U/Ko.Petition/A.No. 1/5

ORDER

This writ petition has been filed challenging impugned order passed by the second respondent dated 22.04.2025 and consequently directing the respondents 1 to 3 to restore the name of the service connection in S.C.No. 250010444 in favour of the Petitioner's father, Palaniyandi.

2. The petitioner and the fourth respondent are siblings and the children of Late.Palaniyandi. Apart from the petitioner and the fourth respondent, there are also other legal heirs, namely, Chittupillai, Palanisamy, Lachumi, Alagaperumal.

3. The electricity connection for the bore well for agricultural purposes, was earlier standing in the name of the petitioner and fourth respondents's father, namely Late.Palaniyandi, who died on 15.09.2012. 2/5

4. It appears that the fourth respondent had sunk a bore well and intended to utilise the same power connection which was standing in the name of their father Palaniyandi for tapping water from it. Hence the legal heirs and the joint patta holders, whose name have been specified above have given a consent letter for change over dated 31.01.2014.

5. However, by the impugned communication, the entire service connection has been transferred in the name of the fourth respondent. As a result of which there is some confusion between the family members.

6. Considering the same, the writ petition stands disposed of by directing the second respondent to re-consider the order passed on 22.04.2025 in the light of the consent letter dated 30.01.2014, after due notice to the fourth respondent. This exercise shall be completed within a period of two weeks from the date of receipt of a copy of this order. No costs.
