Respondents Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Mandamus, to direct the 1st and 2nd respondents to provide suitable working instructions in the matter of implementation of the order of the State Commission (TNERC) issued in R.A.No.6 of 2013 dated 31.03.2016 and to allow all the benefits provided in the order for the petitioner.

ORDER

The petitioner is a Captive Consumer. He has filed this writ petition for a Mandamus, directing the 1st and 2nd respondents to provide suitable working instructions in the matter of implementation of the order of the State Commission (TNERC) issued in R.A.No.6 of 2013 dated 31.03.2016.

2. Today, when this writ petition is taken up for hearing, the learned counsel for the respondents submits that the TNERC in R.A.No.6 of 2013 has ordered to re-fix the charges for Tariff based on Time Value of Money and also for Banking Charges as 10% of banked energy in kind instead of 94.00 paise per unit. Pursuant to the same, the Chairman cum Managing Director/TANGEDCO has approved for implementation of the order in R.A.No.6 of 2013 on 31.03.2016 retrospectively for the period from 2012 to 2016. Accordingly, a detailed working instructions was prepared and issued to the authorities concerned.

3. Recording the said submissions, this writ petition is closed. No costs. Consequently, connected miscellaneous petition is closed. 23.01.2024 ogy NCC : Yes / No.
