PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 to take necessary action on the petitioners representation dated 08.11.2023 and 08.08.2024 to remove the encroachment made by the respondents 4 to 6 herein and thereby direct the respondents 1 to 3 to survey the water stream and bring back to its original position which is situated in S.Nos. 955/4, 956/2, 957/6 Kasavanampatti Village, Dindigul West Taluk, Dindigul District on the southern side of petitioners patta lands S.Nos. 955/3A, 955/3B, 955/3C, 955/3D, 955/1C, 955/1D. ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The relief sought for in the present writ petition is to direct the respondents 1 to 3 to take necessary action on the petitioners representation dated 08.11.2023 and 08.08.2024 to remove the encroachment made by the respondents 4 to 6 herein and thereby, direct the respondents 1 to 3 to survey the water stream and bring back to its original position which is situated in S.Nos. 955/4, 956/2, 957/6 Kasavanampatti Village, Dindigul West Taluk, Dindigul District, on the 2/5

southern side of petitioner's patta lands in Survey Nos. 955/3A, 955/3B, 955/3C, 955/3D, 955/1C and 955/1D.

2. With reference to the grievances of the petitioner, the Tahsildar conducted an inspection and the written instructions given by the Tahsildar shows that the subject location is classified as 'cart track', however, there is no encroachment identified. This being the factum stated by the Tahsildar, no further adjudication needs to be entertained. If at all any further actions are required for clearing the bushes in that locality, the petitioner is at liberty to approach the Panchayat concerned for appropriate actions.

3. Accordingly, the writ petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed. (S.M.S., J.) & (A.D.M.C., J.) 28.07.2025 NCC : Yes / No Index : Yes / No PKN 3/5
