ORDER

This writ petition has been filed for a Mandamus to direct the respondents to release the petitioner's Honda Dio Bearing Registration No.TN-79-L-6727 from their custody on the basis of his representation dated 28.07.2025.

2. It is noticed that the petitioner's father was caught while smuggling 120kgs of rice using the petitioner's vehicle bearing Registration No.TN-79L-6727. In this connection, an FIR has been registered in Crime No.161 of 2025 dated 29.06.2025 for offences under Sections 6(4) of TN Scheduled Commodities (RDCS) Order, 1982 and 7(1)(a)(ii) of the Essential Commodities Act, 1955.

3. The learned counsel for the petitioner submits that the petitioner is not involved in any manner with the alleged offence purportedly committed by his father.

Having perused the FIR filed in Crime No. 116 of 2025, this Court is inclined to come to rescue the petitioner by directing the release of the subject Vehicle provisionally, subject to the petitioner depositing a sum of Rs.10,000/- with the third respondent. This is without prejudice to the rights of the official respondents to initiate appropriate proceedings for confiscation.

5. The writ petition stands disposed of with the above direction. No costs.
