ORDER

The petitioner has filed this writ petition seeking a direction to the respondents 1 and 3 to furnish the FIR copy in Crime No.16 of 2025 under Sections 498(A), 294(b), 323, 506(i) IPC and Section 67 IT Act and Section 4 of TNPWH Act, by considering her representation dated 14.08.2025.

2. The learned Additional Public Prosecutor submits that the petitioner is seeking a copy of the FIR in Crime No.16 of 2025 and she is no way connected with Crime No.16 of 2025. He further submits that the petitioner's complaint is still pending under petition enquiry and it has been referred to the Social Welfare Officer.

3. The learned counsel appearing for the petitioner submits that the petitioner has lodged a complaint in the month of January 2025. The respondent Police has also furnished a copy of the FIR as if they have registered a case in Crime No.16 of 2025 on 10.07.2025.

4. This Court considered the rival submissions made.

5. It appears that the respondent Police has not treated the petition enquiry in a proper manner.

6. Therefore, this Court directs the Superintendent of Police, Madurai, to look into this issue, ascertain as to how the petitioner's complaint dated 22.01.2025 has been kept pending without any progress for the past eight months and to transfer the enquiry from the file of the respondent Police to some other sincere investigation officer and ensure that appropriate action is taken on the complaint of the petitioner. The Superintendent of Police shall also ascertain the manner in which the communication has been provided to the petitioner that they have registered the case in Crime No.16 of 2025 on 10.07.2025. In the event, if there is any foul play committed by the 3/5

respondent Police, necessary action has to taken by the Superintendent of Police to ensure the majesty of the Department.

7. With the above direction, this writ petition is disposed of. No costs.
