To call for the records pertaining to the order dt/30/6/2023 in MC No.65/2017 made by the Family Court, Tiruchirappalli and set aside the same. Order : This Criminal Miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.BALAJI THIRUMOORTHY, Advocate for the petitioner, the court made the following order:- 1/3

This Court, by order dated 05.09.2023, has granted an order of interim stay with a condition that the petitioner shall deposit a sum of Rs.7,00,000/- of arrears amount of maintenance pending as of now, on or before 27.09.2023 and continue to pay the monthly maintenance amount awarded by the trial Court till the disposal of the criminal revision case.

2.Today, when the matter was taken up for hearing, without complying the conditional order, the learned counsel for the petitioner seeks an adjournment. 3.In view of the non-compliance of the conditional order passed by this Court on 05.09.2023, the interim stay already granted by this Court stands vacated. Accordingly, this Criminal Miscellaneous petition is dismissed.
