This Writ Petition has been filed for the issue of Writ of Mandamus directing the first and second respondents to consider the representation made by the petitioner on 29.10.2021, wherein, the petitioner has sought for disconnection of service connection given to the third respondent. 2.The case of the petitioner is that the third respondent, who had encroached upon the property belonging to the petitioner, had put up a thatched house and had got the service connection from the respondent department. A representation was made for disconnecting the service connection and since the same was not considered, the present Writ Petition has been filed before this Court.
3.Heard Mr.T.A.Ebenezer, learned Counsel appearing on behalf of the petitioner, Mr.S.Deenadhayalan, learned Sanding Counsel appearing on behalf of the respondents 1 and 2 and Mr.A.Rajamanickam, learned Counsel appearing on behalf of the third respondent. 2/4
4.Taking into consideration the facts and circumstances of the case and the limited relief sought for in this case, there shall be a direction to the petitioner to make a fresh representation to the second respondent and on receipt of the same, the second respondent shall hear the petitioner and the third respondent and take a decision within a period of four weeks from the date of receipt of the fresh representation from the petitioner.
5.The Writ Petition is disposed of with the above directions. No costs.
