PRAYER:- Writ Petition - filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, to direct the respondents to regularize the petitioner service from 19.09.2000 the date from which petitioner was appointed as full time night watchman in Government Higher Secondary School, Kadiyapattanam and grant all service benefits and pension benefits according to rules and take 50% of the previous part time service for pension purposes according to pension rules.

Mr.A.K.Manikkam, learned Special Government Pleader would point out that the petitioner has sought identical relief as sought for in this writ petition (i.e.,) regularization of her service from 19.09.2000 and grant of all consequential service and pension benefits in an earlier Writ Petition in W.P.(MD).No.17776 of 2013. That writ petition came to be dismissed on 27.08.2013, suppressing which, the present Writ Petition has been filed seeking identical relief.

2. The learned counsel for the petitioner does not dispute the aforesaid factual position and only states that he may be permitted to withdraw the Writ Petition.

3. In line with aforesaid, this Writ Petition is dismissed. No costs.
