ORDER

The petitioner herein seeks a direction to the respondents to conduct survey of the property situated in Survey No.61/2, Thottiyam Village, Thottiyam Taluk, Trichy District, by considering his application dated 13.02.2023.

2.Heard the arguments of Mr.R.Ponkarthikeyan, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents 1 and 2. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

3.According to the petitioner, he claims right over the subject property under a partition deed dated 20.08.2018. The patta for the subject property stands in the names of the petitioner and one Ravikumar in Patta No. 2151. The petitioner submitted an application on 13.02.2023 seeking survey of the subject property. The same has not been considered. Hence, the petitioner has come before this Court.

4.The learned Additional Government Pleader appearing for the respondents would submit that the survey of the property could not be conducted due to the dispute between the petitioner and the adjacent land owner, Ravi Kumar.

5.In view of the same, without expressing any opinion on the merits of the matter, the respondents are directed to consider the application of the petitioner dated 13.02.2023 and pass final orders on its own merits within a period of eight weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, the above mentioned Ravikumar, neighbouring land owners and other interested parties.
