ORDER

The Writ Petition is filed seeking a direction to the first respondent to dispose of the petition filed by the petitioner dated 03.07.2025 seeking cancellation of patta issued by the second respondent in respect of the property situated in Survey Nos.735/12 and 735/13 in Nelkattum Seval Village, Sivagiri Taluk, Tenkasi District.

2. Since no adverse order is going to be passed against the respondents 3 and 4, notice to them is dispensed with.

3. According to the petitioner, the subject property is a public pathway used to have access to the Village temple. The respondents 3 and 4 obtained patta from the second respondent in respect of the property, which is a public pathway and are attempting to put up a construction. Therefore, the petitioner submitted instant representation dated 03.07.2025 before the respondents 1 and 2 seeking cancellation of patta issued in the names of the respondents 3 and 4 on the ground that it is a public pathway. The same has not been considered. Hence, the petitioner has come before this Court.

4. The learned Government Advocate, who takes notice for the respondents 1 and 2, would submit that the representation of the petitioner will be considered in accordance with law.

5. In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the representation of the petitioner dated 03.07.2025 and pass final orders on its own merits within a period of twelve (12) weeks from the date of receipt of a copy of this order after issuing notice to the petitioner and the respondents 3 and 4.

6. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
