PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.19 of 2021 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioners/accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 498 (A), 354 and 506(1) IPC, in Crime No.19 of 2021 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that there was matrimonial dispute between the parties, that the petitioners demanded additional dowry from the defacto complainant, that the third accused tried to misbehave with the defacto complainant in drunken mood and sixth accused used to purchase liquor to the third accused and that the first petitioner, is an impotent. Hence, the complaint. 3.The learned counsel for the petitioners would submit that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. He would further submit that this Court has already granted anticipatory bail to the accused 3 to 6 and that now charge sheet has already been filed.

CRL OP(MD). No.20156 of 2021 4.The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that the respondent police, after completing the investigation, has laid the charge sheet in C.C.No.180 of 2022 and is pending on the file of the learned Additional Mahila Court, Madurai. He would further submit that the learned Magistrate has ordered to issue summons to the petitioners. 5.As rightly pointed out by the learned Government Advocate (Criminal Side), since the allegations levelled were serious against the petitioners, this Court has granted anticipatory bail to the other accused and dismissed the petition so far as the present petitioners concerned in Crl.O.P.(MD)No.17028 of 2021 vide order dated 24.11.2021.

6.Since summons were issued to the petitioners, the question of anticipatory bail does not arise.

7.However, the petitioners are at liberty to appear before the learned Magistrate and if directed by the learned Judicial Magistrate, they can very well execute the necessary bonds for their future appearance and for future proceedings, if any. 8.With the above directions, this Criminal Original Petition is disposed of.
