For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.112/2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioners/A1, A3, A4 & A5, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 147, 341, 342, 294(b), 323, 324, 355, 427, 307 and 506(2) IPC, in crime No.112 of 2022 on the file of the respondent police, seek anticipatory bail.
2.The case of the prosecution is that the de-facto complainant is the brother-in-law (Sister's husband) of the fourth petitioner/A5. Due to money dispute between the parties, A5 attacked the de-facto complainant. Hence, the complaint. 3.The learned counsel for the petitioners would submit that the petitioners are innocents and they have been falsely implicated in this case. CRL OP(MD). No.18375 of 2022 was also observed by this Court in Crl.O.P.(MD)No.18418 of 2021, dated 19.07.2022. Hence, he prays for anticipatory bail. 4.The learned Government Advocate (Crl. side) would strongly opposed this petition stating that the injured is still in hospital and the investigation is pending.
5.Considering the gravity and nature of the offence and also considering the facts that the injured is still in hospital and the investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioners.
