Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of certiorarified mandamus to call for the records relating to the Desertion Order Na.Ka.No.L.1/Ma.Vi.221/2017-C.P.No.427/2017, dated 20.03.2017 passed by the fourth respondent and quash the same and consequently direct the third respondent to permit the petitioner to join duty forthwith and to treat the period from 24.02.2017 to the date of joining duty as duty period along with the service, monetary and other benefits, within a time stipulated by this Court.

It is represented by the learned counsel for the petitioner that the petitioner is dead. It is also represented by the learned Additional Government Pleader appearing for the official respondents that subsequent to the death of the petitioner, all the monetary benefits have been paid to the

legal heirs of the deceased petitioner. However, learned counsel for the petitioner would submit that the reimbursement of the medical bills of the deceased petitioner has not been made by the respondents.

2. Since the petitioner is dead and the legal heirs of the deceased petitioner have been paid most of the monetary benefits even according to the learned counsel for the petitioner, this writ petition is disposed of by granting liberty to the legal heirs of the deceased petitioner to file appropriate proceedings, if they so desire, seeking recovery of the amounts paid by the deceased petitioner towards the medical bills, which according to the legal heirs of the deceased petitioner, have not been reimbursed to the deceased petitioner, in the manner known to them under law. No costs. Consequently, connected miscellaneous petitions are closed. 08.08.2024 NCC :
